If a city has a ban on dispensaries can you still start a delivery service in that city since you're not operating out of a storefront?
I have similar concerns that follow that same topic line. First, you must have a properly formed and established collective, or you will be just another dope dealer. I have incorporated a legal non-profit mutual benefit CA Corp. and am signing up members with a very descriptive membership form. I have patient cultivators and patients in need, yet the cities in the area are all anti-marijuana, especially the misinformed county Sheriffs office. I would like to start as just a delivery service, but all the suggestions point toward local business license. (Even as a delivery service, you will need to obtain a BOE sellers permit and at least a dba for protection under the bill SB420) if you don't follow the corporate route, which I think offers the best indication that attempts to follow the letter of the law are legit. Many would argue that you don't need to go that far, but in the future, these semi-compliant entities will be the first to go and be singled out as 'for profit' ventures and will catch the attention of the powers that want to eradicate the whole thing.
Back to the delivery service. As a fully compliant collective, the right to possess, transport, provide(sell & purchase) cultivate is granted to all members under SB420. The city would like you to think that you must register and obtain a local license, but it does not make sense that there may be 20 cities in a 10 sq. mile radius and registering in each one is not feasible.
Deliveries operate out of the public's eye and don't generally bother anyone, but the legal local license issue is a concern. One suggestion I got from my attorney is register a separate dba in your name for a delivery service for say-health and beauty supplies, then contract yourself out to your own collective.
